DAS Report Terms of Service
Effective October 15, 2026
These Terms govern the DAS Report website and service provided by Knecht Strategies LLC to customer organizations and authorized users. The person ordering a paid service for an organization must have authority to bind it. A separately signed agreement controls conflicting provisions; a signed data-processing agreement controls its subject matter. The Privacy Policy describes relevant information practices and does not waive non-waivable rights.
1. The service
DAS Report provides browser-based tools for apprenticeship programs and associations to receive and manage contractor DAS 140 and DAS 142 submissions, related files, receipt history and reporting. The existing SoCal and NorCal tools remain free. Ordering the paid organizational service is a separate choice and does not convert use of those existing tools into a paid subscription.
DAS Report is privately operated by Knecht Strategies LLC and is not a government agency. It does not provide legal advice or certify compliance with all apprenticeship or public-works requirements.
2. Getting started and onboarding
The website's Sign Up link opens Stripe checkout for the organization plan. Sending a contact inquiry does not make a payment, start recurring charges or instantly activate an organization account. Paid services begin through a separately accepted order or signup process that discloses the applicable terms and obtains payment authorization.
For a new paid organization, Ken will reach out within one to two business days after signup to arrange onboarding. Account access is enabled through that process; this contact commitment does not guarantee a completed activation date.
3. Paid subscription and payment
When a paid organizational subscription is ordered, the plan costs US $349 per organization per month and includes unlimited submissions. The first charge is made immediately when the paid subscription is purchased. There is no free trial and no setup fee. The subscription renews and is charged monthly until canceled.
By accepting a paid order, the customer authorizes the disclosed recurring monthly charges to its selected payment method and must provide accurate billing information and an authorized method. Any transaction tax we are required to collect will be disclosed in the applicable payment or billing process.
A price change will not apply retroactively to a paid period. Before a higher recurring price takes effect, we will notify the customer and provide an opportunity to cancel before that renewal. These paid billing provisions do not charge visitors or users of the existing free tools.
4. Cancellation and refunds
For an ordered paid subscription, request cancellation through the website contact form or support@das.report before the next renewal. We handle cancellation manually, acknowledge the request and stop the next renewal for a timely request. Access continues through the current paid billing period unless suspended for a reason allowed under these Terms.
Partial billing periods are not prorated. This does not limit refunds required by law or corrections of billing errors. Contact us about billing mistakes or refund questions; we review them individually. Cancellation of billing and deletion of stored information are separate processes.
5. Accounts and acceptable use
Customers are responsible for accurate account information, authorizing staff, managing access when roles change and safeguarding sign-in access. Report suspected unauthorized access promptly through the contact form or support@das.report.
Do not use the service unlawfully, submit malicious code, access another organization's data without authority, interfere with the service, bypass access controls or misrepresent a submission, receipt, identity or compliance status. Do not resell access or provide it to unrelated organizations without our agreement.
6. Customer data and confidentiality
As between the parties, customers retain their rights in forms, files and other material submitted by or for them. Customers authorize us to host, store, copy, transmit, display and process that information as needed to provide and support the contracted service, carry out authorized instructions and comply with applicable law, subject to the Privacy Policy and any data-processing agreement.
Customers and submitters are responsible for the rights, notices, permissions and lawful authority needed to submit information and direct its processing. Submit only information appropriate and reasonably necessary for the intended workflow.
Each party will use the other's nonpublic information only for the agreement's purposes and protect it with reasonable care. Disclosure is permitted to personnel or service providers who need it for those purposes and are subject to appropriate confidentiality obligations, or where legally required. This restriction does not cover information lawfully public, previously known without restriction, independently developed or lawfully obtained without restriction from another source.
7. Submissions and compliance responsibility
Customers and submitters remain responsible for accurate and complete information, authorized submissions, appropriate recipients, deadlines and their underlying legal obligations.
A record or status shown by DAS Report demonstrates only the event actually recorded. It does not by itself guarantee statutory compliance, human review, agency acceptance, apprentice availability or dispatch. Review identified failures and incomplete records and retain records needed for your obligations. Assisted extraction can make mistakes and requires staff review.
This section does not remove an express responsibility DAS Report has agreed to perform.
8. Support and service changes
Support is available through the website contact form and support@das.report. Apart from the onboarding contact commitment above or a separate written agreement, no fixed support response time, uptime percentage, service credit or backup/recovery deadline is promised.
We may maintain and update the service. We will not use this provision to retroactively remove an express commitment for a paid period. Material changes affecting ongoing paid use will be communicated to the customer.
9. Suspension and termination
We may proportionately restrict access where reasonably necessary to address a material security threat, unlawful use or material breach of these Terms. Where practical and lawful, we will give notice and an opportunity to resolve the issue.
Nonpayment handling, termination for an unresolved breach and discontinuation of the service will be addressed through notice and in accordance with applicable law and any signed agreement. We will not treat a failed charge as authorization for immediate deletion of customer data.
10. Export and retention
Customers should retain records needed for their legal and business purposes. Authorized administrators can export supported submission fields as CSV, and authorized staff can access supported files and receipts. Do not assume CSV includes every uploaded file or a complete account archive. Contact us for help with other exports.
Cancellation does not automatically erase submission records. Export and deletion requests are handled manually, subject to customer agreements and legal recordkeeping requirements. Retention is based on the purposes and criteria described in the Privacy Policy; no automatic deletion date or fixed post-cancellation export period is promised.
11. Intellectual property and service limitations
Knecht Strategies LLC and its licensors retain their rights in the software and service materials, excluding customer data and third-party materials. These Terms do not claim ownership of government forms. Customers receive a limited, nonexclusive right to use the service for their authorized business purposes during their applicable service term.
Except for express written commitments and rights that cannot lawfully be excluded, the service is provided as is and as available. To the extent permitted by law, implied warranties of merchantability, fitness for a particular purpose and noninfringement are disclaimed. We do not guarantee uninterrupted or error-free operation, external recipients' actions or compliance achieved solely by using the service.
Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.
12. General provisions and contact
California law governs these Terms, subject to mandatory applicable law. The parties may use the business contact methods above to try to resolve a dispute. Any court proceeding must be brought in a court with jurisdiction.
We will provide notice of material changes and seek renewed agreement where required by law. Changes will not retroactively alter accrued rights or charges. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. The parties are independent contractors.
For questions about these Terms, use the website contact form or write to support@das.report.
